Terms of Use
1. Introduction
These Terms and Conditions "Terms" govern the use of the LITPAY platform, a service provided by LITPAY CASE MANAGEMENT II LLP to assist collection agencies in boosting their collections through digital communications, including WhatsApp, email, and SMS.
2. User Registration
- Eligibility: Only registered collection agencies are eligible to use the LITPAY platform. By registering, you confirm that you are a legally authorized representative of a collection agency.
- Account Security: Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
3. Use of Services
- Communication Tools: The LITPAY platform enables users to send legal notices, payment reminders, and other messages to defaulters via WhatsApp, email, and SMS. Users are responsible for ensuring that all communications comply with applicable laws and regulations.
- Prohibited Conduct: Users agree not to use the platform for any unlawful purposes or in any way that could harm LITPAY, other users, or defaulters.
4. Fees and Payment
- Pricing: Fees for using the LITPAY platform are outlined on our website or in your service agreement. Payment is due as specified in your service agreement.
- Late Payments: Failure to make timely payments may result in suspension or termination of your account.
5. Data Privacy
- Data Ownership: Collection agencies retain ownership of the data they provide to LITPAY CASE MANAGEMENT II. By using the platform, you grant LITPAY CASE MANAGEMENT II the right to process this data as necessary to provide the services.
- Compliance: Users are responsible for ensuring that their use of the platform complies with all applicable data protection laws.
6. Limitation of Liability
LITPAY is not liable for any damages arising from the use of our platform, including but not limited to loss of data, loss of revenue, or legal liabilities arising from improper use of the service.
7. Termination
- Termination by User: You may terminate your account at any time by providing written notice to LITPAY.
- Termination by LITPAY: We reserve the right to suspend or terminate accounts that violate these Terms or engage in activities that could harm LITPAY or others.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without reference to principles of conflict of laws and the courts in New Delhi shall have exclusive jurisdiction to determine any disputes arising out of, under, or in relation to this Agreement.
9. Arbitration
In the event of the Disputethe Parties shall refer the dispute for arbitration, in an expedited procedure, through a sole arbitrator appointed mutually by both the Parties through an online dispute resolution platform "Institution", consented by both the Parties. The arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof. The seat and venue of arbitration shall be Delhi, India and the language of the proceeding shall be English. The award of the Arbitrator shall be final and binding on the Parties. The arbitration shall be conducted online through the Institution. The Parties agree to consider settling the dispute amicably on recommendation by the Arbitral Tribunal.
10. Changes to These Terms
LITPAY reserves the right to modify these Terms at any time. Users will be notified of any significant changes, and continued use of the platform constitutes acceptance of the new Terms.
